RE: The tariff classification of a confectionary anti-sticking agent from Germany
Dear Mr. Millington:
In your letter dated June 7, 2021, you requested a tariff classification ruling on behalf of your client, Capol LLC.
An ingredients breakdown and product specification sheet accompanied your inquiry. CapolĀ® 41-5568 is said to be composed of vegetable oil, carnauba wax and ascorbyl palmitate. The product is described as an odorless whitish to yellowish liquid dispersion that functions as an anti-sticking agent for confectionery production. The product may be packaged in 10 kg., 100 kg., or 180 kg., net weight, plastic airtight containers made of a high-density polyethylene.
The applicable subheading for CapolĀ® 41-5568 will be 2106.90.9898, Harmonized Tariff Schedule of the United States (HTSUS), which provides for food preparations not elsewhere specified or included . . . other . . . other . . . other. The general rate of duty will be 6.4 percent ad valorem.
