RE: The tariff classification of UV 2908 (CAS # 67845-93-6) from China
Dear Mr. Rogers:
In your letter dated March 16, 2023, you requested a tariff classification ruling.
The subject product is called UV 2908 (CAS # 67845-93-6). It is also known as n-Hexadecyl-3,5-di-tert-butyl-4-hydroxybenzoate, Hexadecyl 4-hydroxy-3,5-bis(2-methyl-2-propanyl)benzoate and Benzoic acid, 3,5-bis(1,1-dimethylethyl)-4-hydroxy-, hexadecyl ester. It is a benzoate-type light stabilizer used in conjunction with other products in the production of polyolefins.
The applicable subheading for the UV 2908 (CAS # 67845-93-6) will be 2918.29.7500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for carboxylic acids with phenol function but without other oxygen function, their anhydrides, halides, peroxides, peroxyacids and their derivatives: Other: Other: Other….. The rate of duty will be 6.5 percent ad valorem..
Pursuant to U.S. Note 20 to Subchapter III, Chapter 99, HTSUS, products of China classified under subheading 2918.29.7500 HTSUS, unless specifically excluded, are subject to an additional 25 percent ad valorem rate of duty. At the time of importation, you must report the Chapter 99 subheading, i.e., 9903.88.03, in addition to subheading 2918.29.7500, HTSUS, listed above.
The HTSUS is subject to periodic amendment so you should exercise reasonable care in monitoring the status of goods covered by the Note cited above and the applicable Chapter 99 subheading.
