RE: The tariff classification of Evening Primrose and Grapeseed Oils from China
Dear Ms. Wang:
In your letter dated April 24, 2023, you requested a tariff classification ruling.
The subject merchandise is Encapsulated Evening Primrose and Grapeseed Oils. The product which consists of an encapsulated blend of the two types of oils will be packed and shipped in bulk quantities and sold for use as a dietary supplement.
The applicable subheading for the Encapsulated Evening Primrose and Grapeseed Oils will be 1517.90.2080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for: “Edible mixtures or preparations of animal or vegetable fats or oils or of fractions of different fats or oils of this chapter, other than edible fats or oils or their fractions of heading 1516: Other: Artificial mixtures of two or more of the products provided for in headings 1501 to 1515, inclusive: Other: Other.” The rate of duty will be 8 percent ad valorem.
Pursuant to U.S. Note 20 to Subchapter III, Chapter 99, HTSUS, products of China classified under subheading 1517.90.2080, HTSUS, unless specifically excluded, are subject to an additional 7.5 percent ad valorem rate of duty. At the time of importation, you must report the Chapter 99 subheading, i.e., 9903.88.15, in addition to subheading 1517.90.2080, HTSUS, listed above.
The HTSUS is subject to periodic amendment so you should exercise reasonable care in monitoring the status of goods covered by the Note cited above and the applicable Chapter 99 subheading.
