RE: The tariff classification of a ground temperature sensor from China
Dear Mr. Libraro:
In your letter dated January 23, 2024, you requested a tariff classification ruling. Descriptive literature was provided for our review.
The item under consideration is described as the DFRobot TS01 infrared (IR) temperature sensor designed for non-contact sensing of road surface temperature. The sensor has a built-in temperature compensation that ensures the accuracy of the temperature measurement and is wrapped with a metal casing to protect it against impact, water and dust. The product has an operating temperature of -40 degrees Celsius to 85 degrees Celsius and can be used to measure the temperature range of -70 degrees Celsius to 380 degrees Celsius while providing a maximum accuracy of 0.5 degrees Celsius. The output is provided as a voltage from 0 to 3V, which corresponds to a specific temperature. An optical filter (long-wave pass), which cuts the visible and near infrared radiant flux, is integrated into the package to provide ambient and sunlight immunity. The probe diameter measures 0.61 inches and is 3.07 inches long. The attached shielded cable length measures 59.06 inches. The TS01 IR temperature sensor is imported with the sensor attached to the cable, along with a certificate, and a warranty card.
The applicable subheading for the DFRobot TS01 infrared temperature sensor will be 9025.19.8060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Hydrometers and similar floating instruments, thermometers, pyrometers, barometers, hygrometers and psychrometers, recording or not, and any combination of these instruments; parts and accessories thereof: Thermometers and pyrometers, not combined with other instruments: Other: Other: Other: Infrared thermometers.” The general rate of duty will be free.
Pursuant to U.S. Note 20 to Subchapter III, Chapter 99, HTSUS, products of China classified under subheading 9025.19.8060, HTSUS, unless specifically excluded, are subject to an additional 25 percent ad valorem rate of duty. At the time of importation, you must report the Chapter 99 subheading, i.e., 9903.88.02, in addition to subheading 9025.19.8060, HTSUS, listed above. The HTSUS is subject to periodic amendment so you should exercise reasonable care in monitoring the status of goods covered by the Note cited above and the applicable Chapter 99 subheading. For background information regarding the trade remedy initiated pursuant to Section 301 of the Trade Act of 1974, you may refer to the relevant parts of the USTR and CBP websites, which are available at https://ustr.gov/issue-areas/enforcement/section-301-investigations/tariff-actions and https://www.cbp.gov/trade/remedies/301-certain-products-china respectively.
Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided at https://hts.usitc.gov/current.
