RE: The tariff classification of liquid pumps from Mexico
Dear Mr. Murphy:
In your letter dated July 21, 2003 you requested a tariff classification ruling on behalf of your client Gilbarco.
The articles in question are described as the GASBOY Split 70 Series transfer pump, the GASBOY 580 Series pump, the GASBOY 1200 Series rotary hand pump, and the GASBOY Model 124 quarter stroke pump. You indicate that the Split 70 and 580 Series pumps are designed to dispense gasoline, diesel or other petroleum fuel products for private fleet fueling applications, while the 1200 Series is generally used to dispense petroleum fuel products and certain types of oils from drums or tanks. The Model 124 quarterstroke pump is intended for dispensing other liquids, such as solvents, chemicals, etc., in addition to fuel and lubricants. All of the subject pumps are either fitted with a measuring device that allows for the volumetric control of the quantity of liquid discharged, or designed to be fitted with such a device as an option. Descriptive literature was submitted.
The applicable subheading for the GASBOY Split 70 Series transfer pump, the GASBOY 580 Series pump, and the GASBOY 1200 Series rotary hand pump will be 8413.11.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for pumps for dispensing fuel or lubricants, of the type used in filling-stations or in garages, fitted or designed to be fitted with a measuring device. The rate of duty is free.
The applicable subheading for the GASBOY Model 124 quarterstoke pump will be 8413.19.0000, HTSUS, which provides for other liquid pumps fitted or designed to be fitted with a measuring device. The rate of duty is free.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
