RE: The tariff classification of a ball bearing from China

Dear Mr. Hackbarth:

In your letter dated October 24, 2005 you requested a tariff classification ruling on behalf of your client Rhino Mfg. Group.

The article in question is described as a ball bearing with an outside diameter of 1 3/8 inches. A picture of the bearing was submitted.

In your request you indicate that the subject ball bearing was previously classified in subheading 8482.10.5032, Harmonized Tariff Schedule of the United States (HTSUS), which provides for maximum or full capacity type ball bearings. However, we cannot determine from the information submitted whether or not the bearing is a maximum or full capacity type ball bearing.

The applicable subheading for the bearing will be 8482.10.50, HTSUS, which provides for other ball bearings. The rate of duty will be 9 percent ad valorem.

In order to determine the appropriate statistical suffix for the bearing we need additional information. Please confirm that the measurement for the outside diameter of the bearing does not include its flange and explain why you believe the bearing to be a maximum or full capacity type ball bearing. In addition, please provide a detailed technical drawing or a disassembled sample of the bearing so that we can determine how the bearing is constructed.

If the required information does not involve sending a sample, you can resubmit your request and the additional information electronically.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
