RE: The tariff classification of a motor from China
Dear Mr. Turner,
In your letter dated November 14, 2005, you requested a tariff classification ruling.
The item concerned is the Universal AC Motor (Part # 1999-11R0017). You state in your letter that its maximum output power is 675.92 Watts.
The purpose of the motor is to power a chainsaw.
Classification of goods in the Harmonized Tariff Schedule of the United States (HTS) is governed by the General Rules of Interpretation (GRIs). GRI 1. states, “ ... classification shall be determined according to the terms of the headings ... “. Heading 8501 provides for “Electric motors ... “.
General Note 3. (h) (vi) to the HTS states, “ ... a reference to “headings” encompasses subheadings indented thereunder.”.
The applicable subheading for the Universal AC Motor (Part # 1999-11R0017) will be 8501.20.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for “Electric motors ... : Universal AC/DC motors of an output exceeding 37.5 W: Exceeding 74.6 W but not exceeding 735 W. The rate of duty will be 4%.
