RE: The tariff classification of a USB storage drive in a case from China.
Dear Mr. Crago:
In your letter dated August 25, 2006 you requested a tariff classification ruling on behalf of your client, Corporate Express.
The merchandise under consideration is a USB storage drive, item number P098ZA00154. The storage drive is embedded in a case shaped like a bottle of a particular brand of soft drink, and incorporates that brand’s trademarked logo. The upper portion of the case can be removed to reveal a USB jack, by which means the storage drive is connected to an ADP machine.
The storage drive has a memory capacity of 256 megabytes, and is for use in a USB 2.0 drive. The outer shell is made of ABS, and it measures approximately 65 mm by 20 mm by 7 mm. The drive weighs about 18 grams.
The applicable subheading for this USB storage drive in a case, item number P098ZA00154, will be 8471.70.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for: “Automatic Data Processing machines and units thereof; magnetic or optical readers, machines for transcribing data onto data media in coded form and machines for processing such data, not elsewhere specified or included: Storage units: Other storage units: Not assembled in cabinets for placing on a table, desk, wall, floor or similar place”. The rate of duty will be Free.
