RE: The tariff classification of actuator-operated air dampers
Dear Mr. Schaefer:
In your letter dated April 17, 1996, on behalf of your client, Johnson Controls, Inc., you
requested a tariff classification ruling.
The items at issue are a series of galvanized steel air dampers. The dampers are designed
to be operated by various mechanical actuators for the purpose of controlling air pressure, room
temperature, smoke or flame movement, or just the amount of air entering, leaving or flowing
through a building. The dampers consist of a metal frame with adjustable louvers.
The applicable subheading for the air dampers will be 8481.80.9050 Harmonized Tariff
Schedule of the United States (HTS), which provides for taps, cocks, valves and similar
appliances, other than manually operated or check, other. The rate of duty will be 3 percent ad
valorem.
This ruling is being issued under the provisions of Section 177 of the Customs Regulations
(19 C.F.R. 177).
