RE: The tariff classification of a girls' tank coverup from Thailand
Dear Ms. Piccirillo:
In your letter dated July 3, 1996 you requested a tariff classification ruling.
The submitted item is made from a fine knit jersey fabric which you indicate is 100% cotton. This pullover garment extends from the shoulders to the vicinity of mid thigh. The upper portion is sleeveless with narrow shoulder straps which are attached in the center back. The front has a deep scoop neckline. Contrasting color knit fabric tubes are wrapped around each front strap separately and both back straps together. The body of this garment is cut wider at the bottom than at the top portion. All edges are hemmed. You have indicated that there will be a screen print on the center front. This will be made in girls' sizes 4-6X and 7-16 and be known as style number 32-13218-7 and 32-13218-4.
The applicable subheading for the coverup will be 6114.20.0060, Harmonized Tariff Schedule of the United States (HTS), which provides for Other garments, knitted or crocheted: Of cotton: Other: Women's or girls'. The rate of duty will be 11.4 percent ad valorem.
This garment falls within textile category designation 359. Based upon international textile trade agreements, products of Thailand are subject to quota and the requirement of a visa.
The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
