RE: The tariff classification of electrical switches from China

Dear Ms. Streveler:

In your letter dated September 25, 1996 you requested a tariff classification ruling.

As indicated by the submitted samples and literature, these switches are the push-button type and consist of the switching apparatus and two lengths of insulated electrical wire, with either spring clips or reflector clips attached to the end of the wires. These switches are to be incorporated into portable electric lamps.

The applicable subheading for the electrical switches will be 8536.50.8031, Harmonized Tariff Schedule of the United States (HTS), which provides for other electrical switches, for a voltage not exceeding 1,000 V. The rate of duty will be 4.3 percent ad valorem. You have suggested classification under subheading 8513.90.4000, HTS, which provides for parts of portable electric lamps other than flashlights. This classification is precluded by Additional U.S. Rule of Interpretation 1(c) of the Harmonized Tariff Schedule, since subheading 8536.50.8031, HTS, more specifically describes these switches.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
