RE: The tariff classification of a motor bike from China
Dear Mr. Portu:
In your letter dated September 26, 1996, you requested a tariff classification ruling on behalf of Schapiro & Associates, Inc. of Hallandale, Florida.
The item concerned (shown below) is a motor bike (Model #DY50 III A); it measures approximately 5«'L X 2¬'W X 3 'H.
You state that the manufacturer of the item is Dayang, Inc. of China, that it will be shipped as ocean freight and imported into the United States through the Ports of Miami and Port Everglades, Florida as well as any other economically feasible Ports within the same region.
The applicable subheading for the Model DY50 III A motor bike will be 8711.10.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for Motorcycles . . . and cycles fitted with an auxiliary motor . . . : With reciprocating internal combustion piston engine of a cylinder capacity not exceeding 50 cc. The rate of duty will be 2.2% ad valorem.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
