RE: The tariff classification of a bicycle frontlight and rearlight from China
Dear Ms. Wade:
In your letter dated June 27, 1997, you requested a tariff classification ruling on behalf of Sigma Sport USA, L L C (I.R.S. #37-134329200) of Olney, Illinois.
The first item concerned (shown below), the ELLIPSOID (Model FL100), is a 4«"L X 2"W X 2«"H (including clasp) piece of smooth, rectangular-shaped hard black plastic with a clear, hard plastic bulb cover on one end and a hinged, flip-open, black hard plastic clasp on its bottom. Within the bulb cover is a HS 3 Halogen bulb of 6 volts. The packaging box of the item states that the bulb utilizes 2.4 amps, but the molding in the bottom base of the item states that it utilizes 0.4. There is also a small, soft rubber-covered input in the bottom of the item for recharging the batteries with a 9 volt DC recharger.
This item is used to illuminate in front of a bicycle and is intended to be attached to its front handlebar.
The second item (shown below), the DIODE (Model RL100), is a half-moon-shaped piece of black, hard plastic with a red bulb cover on it's curved side; the item measures 4 "W X 1«"H X 1 " Depth. Inside the red bulb cover is a circuit board with four, small LEDs. The board is powered by two AA batteries. Included with the item are two, black, hard plastic halves of a clasp, each with a rubber suction cup on the inside surface, and slide-in hinges. There are slots molded into the flat back of the DIODE light casing into which these hinges slide.
This item is used to illuminate behind a bicycle and is intended to be clasped onto the seat post.
The applicable subheading for both the ELLIPSOID (Model FL100) and DIODE (Model RL100) bicycle lights will be 8512.10.2000, Harmonized Tariff Schedule of the United States (HTS), which provides for Electrical lighting . . . for cycles . . . . The rate of duty will be 3% ad valorem.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
