RE: The tariff classification of computer control or adapter units from Ireland.
Dear Ms. Haupt:
In your letter dated July 8, 1997, on behalf of Cybex Computer Products, you requested a tariff classification ruling.
The merchandise under consideration involves five network interface devices which are utilized as control or adapter units within an automatic data processing (ADP) machine system. These items are known as Personal Commander, Duette Commander, Autoboot Commander II, Plus PC Companion and Plus PC Extender.
These are separate units that are interconnected by cables to the existing computer and accessories. Each item is used to control and connect computers, keyboards, the mouse and monitors located on a desktop or within a LAN system. The Plus PC Extender and Plus PC Companion consist of a transmitter at the computer and a receiver at the remote site linked by an extension cable with an input cable connecting the transmitter to the computer. Connections can be made to a single or multiple personal computers.
Noting Legal Note 5(B) to Chapter 84 HTS, these network interface devices meet the definition of a unit of an automatic data processing machine and are used to interconnect the central processing units (CPU's) to other units, thereby providing control and adaption functions. Headquarters' Rulings 953921, 957325, 954695 and 953205 involves similar merchandise.
The applicable subheading for the Personal Commander, Duette Commander, Autoboot Commander II, Plus PC Companion and Plus PC Extender network interface devices will be 8471.80.1000, Harmonized Tariff Schedule of the United States (HTS), which provides for control or adapter units. The rate of duty will be free.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
