RE: The tariff classification of eyeglass cases from Italy/Hong Kong.
Dear Mr. Ris:
In your letter received at U.S. Customs Service on July 18, 1997, you requested a tariff classification ruling on behalf of Rodenstock USA.
You have submitted three samples with your request, no style numbers, all are eyeglass cases. Two of the cases are textile lined and have a metal foundation covered with reinforced or laminated plastics. The third sample is also textile lined but is constructed of a linen covered paperboard.
The applicable subheading for the plastic covered cases will be 4202.32.1000, Harmonized Tariff Schedule of the United States (HTS), which provides for articles of a kind normally carried in the pocket or in the handbag, with outer surface of sheeting of plastic, of reinforced or laminated plastic. The rate of duty will be 12.1›/kg and 4.6 per cent.
The applicable subheading for the textile case will be 4202.32.8000, Harmonized Tariff Schedule of the United States (HTS), which provides for articles of a kind normally carried in the pocket or in the handbag, with outer surface of textile materials, of vegetable fibers and not of pile or tufted construction. The rate of duty will be 6.9 per cent.
The textile case falls within textile category designation 871. Based upon international textile trade agreements, products of Hong Kong in category 871 are subject to visa requirements.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
