RE: The tariff classification of a woman's knit pullover and shorts ensemble from the Republic of South Africa
Dear Ms. Castellanos:
In your letter dated August 19, 1997, on behalf of Segue Ltd., you requested a tariff classification ruling.
The submitted sample, style MBS-Set, consists of a woman's pullover and shorts ensemble. Both components are constructed from identical 60% cotton/40% polyester knit print fabric. The pullover features a round neck with capping, short hemmed sleeves, sewn-in shoulder pads, and a straight hemmed bottom with side slits. The pull-on shorts features feature an elasticized waist, side seam pockets, and hemmed leg openings.
Your sample will be returned as requested.
The applicable subheading for the pullover will be 6104.22.0060, Harmonized Tariff Schedule of the United States (HTS), which provides for women's or girls' ensembles...of cotton...blouses, shirts and tops. The rate of duty will be 20.3% ad valorem. This is the rte which would apply if the garments were entered separately and classified in subheading 6110.20.2075.
The applicable subheading for the shorts will be 6104.22.0050, HTS, which provides for women's or girls' ensembles...of cotton...shorts. The rate of duty will be 16.2% ad valorem. This is the rate which would apply if the garments were entered separately and classified in subheading 6104.62.2030.
The pullover falls within textile category designation 339. The shorts fall within textile category designation 348. As a product of the Republic of South Africa, this merchandise is not currently subject to a visa requirement and quota restraints based upon international textile trade agreements.
The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
A copy of this ruling letter or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
