RE: The tariff classification of cotton yarn from Pakistan

Dear Mr. Portal:

In your letter dated August 23, 1997 you requested a classification ruling on behalf of Karim's International USA Inc.

You have submitted a cone of yarn which you state is "100% cotton yarn N/E 20/1 carded hosiery, waxed yarn for knitting." Under normal convention, the code "N/E 20/1" means that this is a singles yarn with an English Cotton Yarn Number of 20. It appears to be unbleached and not mercerized.

The applicable subheading for the yarn will be 5205.12.1000, Harmonized Tariff Schedule of the United States (HTS), which provides for cotton yarn (other than sewing thread), containing 85 percent or more by weight of cotton, not put up for retail sale; single yarn, of uncombed fibers; exceeding 14 nm but not exceeding 43 nm; unbleached, not mercerized. The duty rate will be 5.2 percent ad valorem.

This yarn falls within textile category designation 300. Based upon international textile trade agreements products of Pakistan are subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
