RE: The tariff classification of women's dresses from China
Dear Mr. Purcell:
In your letter dated October 27, 1997, you requested a tariff classification ruling on behalf of Pioneer Apparel, Ltd.
Two garments were submitted, style 9072, consisting of a woman's 100% polyester woven dress and a 100% polyester knitted dress. The woven dress is made from a sheer, patterned fabric. It has a rounded neckline and short sleeves. The neckline is finished with bias fabric and the sleeves and bottom are hemmed. The knitted dress has a scooped front and a straight back and has non-adjustable straps. The bottom is hemmed. The garments will be sold as a set with the knitted garment designed to be worn under the woven dress. The sample will be returned as requested.
The applicable subheading for the woven dress will be 6204.43.4030, Harmonized Tariff Schedule of the United States (HTS), which provides for women's or girls' suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): dresses: of synthetic fibers: other: other: other: women's. The rate of duty will be 16.7 percent ad valorem. The applicable subheading for the knitted dress will be 6104.43.2010, HTS, which provides for women's or girls'...dresses...knitted or crocheted: dresses: of synthetic fibers: other: women's. The rate of duty will be 16.7 percent ad valorem.
Both garments fall within textile category designation 636. Based upon international textile trade agreements, products of China are subject to quota and the requirement of a visa.
The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
