RE: The tariff classification of 100% cotton jacquard woven
upholstery fabric from Italy.
Dear Ms. Radosti:
In your letter dated May 6, 1998 you requested a tariff
classification ruling.
The submitted sample, designated as style Ranier, is a
jacquard woven fabric composed of 100% cotton. This product
weighs approximately 254 g/m2, and will be imported in 140
centimeter widths. The fabric is characterized by a complex
woven design and features an intricate geometric motif. This
item is manufactured with yarns of different colors. Your
correspondence indicates that this product will be used in the
upholstery trade.
The applicable subheading for the jacquard woven cotton
fabric will be 5209.49.0020, Harmonized Tariff Schedule of the
United States (HTS), which provides for woven fabrics of cotton,
containing 85 percent or more by weight of cotton, weighing more
than 200 g/m2, of yarns of different colors, other fabrics,
jacquard woven, of a width exceeding 127 centimeters. The rate
of duty will be 8.7 percent ad valorem.
This ruling is being issued under the provisions of Part 177
of the Customs Regulations (19 C.F.R. 177).
A copy of the ruling or the control number indicated above
should be provided with the entry documents filed at the time
