RE: The tariff classification of perforated flat-rolled stainless steel from Japan.

Dear Mr. Alberdi:

In your letter dated January 4, 2000 on behalf of McNichols Company, you requested a tariff classification ruling. A representative sample of the product to be imported was submitted with your request.

Perforated flat-rolled Type 304 stainless steel having a 2B cold-rolled finish will be imported both in coil form and cut-to-length. This product measures 0.3 mm in thickness. The coils measure 500 mm in width and the cut-to-length sheets will be imported in various sizes not over five feet in width and ten feet in length. You state that the perforations measure 0.5 mm in diameter and there are 625 holes per square inch. This perforated steel will ultimately be used in the agricultural field in sugar refinery, food processing, coffee processing and filtering equipment, in light diffusers and in architectural applications such as decorative screens and end panels.

Harmonized Tariff Schedule of the United States (HTS) Chapter 72 Note 1. (k) defines flat-rolled products of Chapter 72. This note states “Flat-rolled products include those with patterns in relief derived directly from rolling…and those which have been perforated, corrugated or polished, provided that they do not thereby assume the character of articles or products of other headings.”

The applicable subheading for the perforated flat-rolled stainless steel measuring 600 mm or more in width will be 7219.90.0025, HTS, which provides for flat-rolled products of stainless steel, of a width of 600 mm or more, other, other, containing more than 0.5 percent by weight of nickel, other. The rate of duty will be 2.4 percent ad valorem.

The applicable subheading for the perforated flat-rolled stainless steel measuring less than 600 mm in width will be 7220.90.0015, HTS, which provides for flat-rolled products of stainless steel, of a width of less than 600 mm, other, containing more than 0.5 percent but less than 24 percent by weight of nickel, other. The rate of duty will be 2.3 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

Attached is information on antidumping case A-588-845 which covers certain stainless steel sheet and strip in coils from Japan. A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
