RE: The tariff classification of handbags and wallets from China.
Dear Ms. Greenwood:
In your letter dated February 17th, 2000 you requested a classification ruling.
The samples submitted with your request are identified as NS Organizers, styles 7302632 and 7302643; Square Organizers, styles 7302631 and 7302642; and Messenger, style 7301821.
NS Organizers (both styles are identical in design) are primarily bi-fold wallets with an exterior surface of a fabric backed sheeting of plastic that measure approximately 7" in length by 4 1/4" in width. The interiors feature a zippered currency slot, a clear vinyl window for an I.D. card, and multiple credit card slots. A center snap closure and a flap with a snap closure secure the wallets. A detachable shoulder strap is affixed to the top interior flaps by means of two snap closures. A small cell phone case that is secured by a front flap with hook and loop closure is incorporated on the rear exterior of the wallet.
Square Organizers (both styles are identical in design) are handbags with an exterior surface of fabric backed sheeting of plastic that measure approximately 5 7/8" x 5 7/8" x 1/2". The interiors feature two accordion compartments separated by a zippered pocket. Multiple credit card slots are sewn to the back wall and front of the zippered compartment. A front flap with a snap closure that also secures the bag conceals an open pocket. A detachable shoulder strap is affixed to the top interior flaps by means of two snap closures. In addition to the flat goods carried in a wallet, the square organizers are designed to contain articles of a kind normally carried in a handbag.
Messenger is a handbag is made of 100% nylon and measures approximately 9" x 12" x 4". The interior features a single compartment with a zippered back wall pocket and is secured by a front flap with a snap closure. Two zippered pockets are incorporated on the front flap. The rear exterior has an open pocket and there is a pocket on each side exterior of the bag.
The applicable subheading for styles 7302632 and 7302643 will be 4202.32.1000, Harmonized Tariff Schedule of the United States (HTS), which provides for articles of a kind normally carried in the pocket or in the handbag…with outer surface of sheeting of plastic, of reinforced or laminated plastics. The duty rate will be 12.1cents/kg + 4.6%.
The applicable subheading for styles 7302631 and 7302642 will be 4202.22.1500, Harmonized Tariff Schedule of the United States (HTS), which provides for handbags, whether or not with shoulder strap…with outer surface of sheeting of plastic. The duty rate will be 17.6% ad valorem.
The applicable subheading for style 7301821 will be 4202.22.8050, Harmonized Tariff Schedule of the United States (HTS), which provides for handbags, whether or not with shoulder strap. The duty rate will be 18.6% ad valorem.
Items classifiable under HTS subheading 4202.22.8050 fall within textile category designation 670. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.
The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
