RE: The tariff classification of fabrics and a quilted bedspread from Korea

Dear Ms. Kim:

In your letter dated April 4, 2000, you requested a classification ruling on behalf of Y.K. Exim Corp.

Three items were submitted and will be returned as you have requested. Style YK001 is described as a pile fabric made of 100 percent acrylic fiber. The swatch appears to be of knit, long pile construction. Style YK002 is described as a narrow fabric for trimming. The sample measures approximately 2 inches in width and appears to be of knit construction. It is claimed to be made of 100 percent polyester fiber. Style YK003 is stated to be a bedspread. It is filled with 100 percent polyester, has a back fabric of 100 percent polyester and a face fabric of 55 percent ramie and 45 percent polyester fiber. This quilted bedspread features heart and flower appliques on the face portion.

The applicable subheading for YK001 will be 6001.10.2000, Harmonized Tariff Schedule of the United States (HTS), which provides for pile fabrics, knitted or crocheted, “long pile” fabrics, of man-made fibers. The duty rate will be 18.1 percent ad valorem.

The applicable subheading for YK002 will be 6002.20.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for other knitted or crocheted fabrics, other, of a width not exceeding 30 cm., other, of man-made fibers. The duty rate will be 8 percent ad valorem.

The applicable subheading for YK003 will be 9404.90.9536, Harmonized Tariff Schedule of the United States (HTS), which provides for mattress supports; articles of bedding and similar furnishing, other, other, other, other, with outer shell of other textile materials, other. The duty rate will be 10.2 percent ad valorem.

YK001 falls within textile category designation 224. Based upon international textile trade agreements products of Korea are subject to quota and the requirement of a visa.

YK002 falls within textile category designation 222. Based upon international textile trade agreements products of Korea are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
