RE: The tariff classification of corporate presentation equipment from Canada.
Dear Mr. Krueger:
In your letter dated September 6, 2000 you requested a tariff classification ruling.
The matter in question concerns the classification of electronic equipment under the HTS provision of 9817.00.9800, imported for the purpose of staging corporate presentations.
This particular HTS provision provides for “Theatrical scenery, properties and apparel brought into the United States by proprietors or managers of theatrical, ballet, opera or similar productions arriving from abroad for temporary use by them in such productions”.
As per the information provided this electronic equipment is used for corporate presentations to display and discuss such things as new products, procedures or mergers.
It is the opinion of this office that this particular merchandise and circumstances do not fit the specific provision of 9817.00.9800. The equipment is not theatrical scenery, properties nor apparel nor is it imported by proprietors or managers of theatrical, ballet opera or similar productions. Therefore each specific item will be classified in its appropriate HTS chapter provisions.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
