RE: The tariff classification of women’s tops from Hong Kong.
Dear Ms. Burgos:
In your letter dated October 17, 2000, on behalf of your client Cherry Stix Ltd., you requested a tariff classification ruling for four garments.
The submitted samples are described as follows:
Style #1335A - a woman’s top constructed from 55% ramie, 45% cotton,
hand-crocheted fabric. The garment features a scoop neckline in front, double spaghetti shoulder straps, wooden beads on the front and back panel, and a self-finished crocheted bottom. The upper edge of the back of the garment is cut straight across, from side seam to side seam.
Style #1333A – a woman’s tank top constructed from 55% ramie, 45% cotton, hand-crocheted fabric. The garment is sleeveless, extends below the waistline, and features a scoop neckline in the front and back, that falls below the nape of the neck, shoulder straps measuring approximately ¾ inch in width and a self-finished crocheted bottom.
Style #1336A - a woman’s top constructed from 55% ramie, 45% cotton,
hand-crocheted fabric. The garment features a v-neckline in front, shoulder straps measuring approximately ½ inch in width, and a self-finished crocheted bottom. The upper edge of the back of the garment is cut straight across, from side seam to side seam.
Style #1334A - a woman’s halter top constructed from 55% ramie, 45% cotton,
hand-crocheted fabric. The garment has a straight neckline in front, is straight in the back (beginning just below the mid-back), ties around the neck and has a self-finished crocheted bottom.

The applicable subheading for the Tops, Style #’s 1335A, 1334A and 1336A, will be 6114.90.9010, Harmonized Tariff Schedule of the United States (HTS), which provides for other garments, knitted or crocheted, of other textile materials, other, tops. The rate of duty will be 5.8 percent ad valorem.
The Tops, Style #’s 1335A, 1334A and 1336A fall within textile category designation 838. Based upon international textile trade agreements products of Hong Kong are subject to quota and the requirement of a visa.
The applicable subheading for the Tank Top, Style #1333A, will be 6109.90.8030, Harmonized Tariff Schedule of the United States (HTS), which provides for T-shirts, singlets, tank tops and similar garments, knitted or crocheted, of other textile materials, other, women’s or girls’, other. The rate of duty will be 16.4 percent ad valorem.
The Tank Top, Style #1333A falls within textile category designation 838. Based upon international textile trade agreements products of Hong Kong are subject to quota and the requirement of a visa.
The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status report On Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available at the Customs Web Site at WWW.CUSTOMS.USTREAS.GOV.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
