RE: The tariff classification of whiskbrooms of broom corn from Colombia.
Dear Ms. Pacheco:
In your letter dated September 15, 2000, on behalf of Industrias Nidalia, you requested a tariff classification ruling.
Industrias Nidalia intends to import whiskbrooms made of broom corn of various prices into the United States from Colombia.
The applicable subheading for whiskbrooms valued not over 96 cents each will be 9603.10.0500, Harmonized Tariff Schedule of the United States (HTS), which provides for brooms and brushes, consisting of twigs or other vegetable materials bound together, with or without handles: whiskbrooms, wholly or in part of broom corn: valued not over 96 cents each: in any calendar year prior to the entry, or consumption, of 61,655 dozen whiskbrooms classifiable under subheadings 9603.10.05 to 9603.10.35, inclusive. The rate of duty will be 8% ad valorem. The applicable subheading for any additional whiskbrooms over and above 61,655 dozen entering the United States and valued at less than 96 cents each are classified under 9603.10.15. The rate of duty will be 5 cents each. The applicable subheading for whiskbrooms valued over 96 cents will be 9603.10.3500, HTS. The rate of duty will be 14% ad valorem.
Even though the tariff rate quota for subheading 9603.10.0500, HTS, is predicated on the imports for three tariff numbers, 9603.10.05 to 9603.10.35, inclusive, there is no limit on the amount of whiskbrooms that can be imported under subheading 9603.10.1500, HTS or 9603.10.3500, HTS.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
