RE: The tariff classification of a knee saver for baseball catchers from China.
Dear Mr. Lawless:
In your letter dated September 27, 2000, you requested a tariff classification ruling, on behalf of BLB Marketing, the importer.
You are requesting the tariff classification on an item that is described as an “AliMed Knee Saver” that is intended for use by baseball catchers (at all levels) in the sport of baseball. The knee saver serves to minimize the strain on the knee joint while the catcher is in the crouched position. The knee saver is constructed of foam pads covered with a nylon textile material. The product may be attached to the catcher’s shin guards through the plastic loops. The lower straps on the shin guards are laced through the loops in the manner shown in the attached literature that accompanies the ruling request.
The applicable subheading for the knee saver used by baseball catchers will be 9506.99.1500, Harmonized Tariff Schedule of the United States (HTS), which provides for “Baseball articles and equipment, except balls, and parts and accessories thereof.” The rate of duty will be free.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
