RE: The tariff classification of a belted skirt for girls’ wear from China
Dear Ms. Greener:
In your letter dated October 5, 2000 you requested a classification ruling.
Submitted style 013-0079, manufactured from blue denim fabric of 100% cotton, is a skirt, which buttons together above the zippered, fly-front opening at the front of the waistband. Threaded through the belt loops surrounding the waistline is a self-fabric belt, which buckles together by means of plastic hardware. Forming part of this belt is a zippered pouch, fringed at its lower edge.
This skirt and belt will also be manufactured from twill fabric of 100% cotton and assigned the same style number.
As you have requested, the sample style is being returned.
The applicable subheading for style 013-0079 in denim will be 6204.52.2040, Harmonized Tariff Schedule of the United States (HTS), which provides for …girls’…skirts…, cotton, other, blue denim, girls’; and in twill will be 6204.52.2080, which provides for …girls’…skirts…, cotton, other, other, girls’. The duty rate will be 8.4 per cent ad valorem for both.
Style 013-0079 falls within textile category designation 342 for either fabrication. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.
The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
