RE: The tariff classification of a woman’s knitted cotton dress and cardigan styled garment from Cambodia

Dear Ms. Bjelis:

In your letter dated November 20, 2000, you requested a tariff classification ruling. Your samples will be returned as per your request.

The submitted sample, Style 5510(71058, 71056), is a women’s two piece knitted outfit consisting of an upper body garment which is constructed of 57% cotton, 25% polyester, 18% linen fabric and a dress which is manufactured of 60% cotton, 40% polyester fabric. The dress, which extends from the shoulders to the mid-calf, is sleeveless, with a crew neckline, and a hemmed bottom with a twelve-inch side slit on the left. The cardigan features a crew neckline, short hemmed sleeves, one button closure at the neckline, and a hemmed bottom with five inch side vents.

The applicable subheading for the dress portion of Style 5510(71058, 71056) will be 6104.42.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for dresses, knitted or crocheted: of cotton: women’s. The rate of duty will be 11.8%.

The applicable subheading for the shirt portion of Style 5510(71058, 71056) will be 6110.20.2075, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar, knitted or crocheted: of cotton: other: other: other: women’s or girls’. The rate of duty will be 18.2%.

The dress and cardigan fall within textile category designation 336 and 339 respectively. Based upon international textile trade agreements, the cardigans made in Cambodia are subject to quota and the requirement of a visa. The dress is subject to the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web Site at WWW.CUSTOMS.GOV. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
