RE: The tariff classification of oil well pumping equipment from Canada.

Dear Ms. Skoreyko:

In your letter dated March 23, 2001 you requested a tariff classification ruling on behalf of your client Weatherford.

The items in question are described as surface drives for oil well cavity pumping systems and hydraulic power transmission skids. Descriptive literature was submitted.

The submitted information indicates that the surface drives are for use with progressing cavity pumping (PCP) systems. The drives transfer mechanical power from a prime mover to the PCP system by providing a means to suspend and rotate a drive string of rods that, in turn, connect to and rotate a bottom-hole pump submersed within an oil well. The drives incorporate a stuffing box that provides for connection to the wellhead and seals the drive string rods within the well casing. A range of separately available prime movers, including electric and hydraulic motors, is used to power the surface drives.

The hydraulic power transmission skid is comprised of a fluid power pump, an industrial engine for a prime mover, and accessory valves, filters and hoses, all mounted on a transportable frame. The power transmission skid is used to provide fluid power for hydraulic motors.

The applicable subheading for the surface drives will be 8413.91.90.80, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other parts of pumps for liquids. The rate of duty is free.

The applicable subheading for the hydraulic power transmission skid will be 8413.60.0040, HTSUS, which provides for other hydraulic fluid power pumps. The rate of duty is free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
