RE: The tariff classification of girls’ garments from Turkey.
Dear Mr. Ralston:
In your letter dated March 14, 2001, you requested a classification ruling on behalf of Paris Geneve Inc. The submitted samples will be returned as per your request.
Five samples of girls’ garments were provided for review. Style 574 consists of a girls’ soft cup brassiere and bikini panty constructed of a knitted cotton fabric in a printed floral design. The brassiere features adjustable elasticized shoulder straps, an elasticized bottom band which measures approximately ½ inch wide with a plastic hook front closure, and fabric capping at the top of the garment. The bikini panty features a three panel front and a elasticized waistband and leg openings
Style 573 consists of a girls’ soft cup brassiere and a pair of shorts constructed of knitted cotton. The brassiere has a seamed front, adjustable elasticized shoulder straps, a fabric covered elasticized bottom band measuring approximately ¾ inch wide, and fabric capping at the top of the garment. The shorts feature a fabric covered elasticized waistband measuring approximately 1-inch wide and a hemmed bottom with a contrasting scallop yarn design.
Style 470 (sizes 4-6-6X) consists of a girls’ underwear crop top and bikini constructed of knitted cotton. The underwear crop top features ½ inch wide shoulder straps, ½ inch wide capped fabric at the top of the garment, elasticized trim at the garment bottom and a printed sheep design centered at the garment front. The bikini panty features an overall printed sheep design, and a elasticized waistband and leg openings. The garments will also be available as Style 570 in sizes 8-10-12-14.
Style 531 is a girls’ tank top constructed of a knitted cotton fabric in a printed floral design. The tank top features ½ inch wide shoulder straps, ½ inch wide capped fabric at the top of the garment, and a “Miss Gem” embroidered label sewn at the front of the hemmed bottom.
Style 515 is a pair of girls’ shorts constructed of knitted cotton floral printed fabric. The shorts feature a fabric covered elasticized waistband measuring approximately ¾ inch wide, a printed fabric bow sewn at the waistband center, and a “Miss Gem” embroidered label sewn at the front of the hemmed bottom.
The applicable subheading for the Styles 574 an 573 brassieres will be 6212.10.9010, HTS, which provides for Brassieres, girdles, corsets, braces, suspenders, garters and similar articles and parts thereof, whether or not knitted or crocheted: brassieres: other: other: of cotton. The rate of duty will be 17.2 percent ad valorem.
The applicable subheading for the Styles 574, 470 and 570 panties will be 6108.21.0020, HTS, which provides for Women's or girls' slips, petticoats, briefs, panties, nightdresses, pajamas, negligees, bathrobes, dressing gowns and similar articles, knitted or crocheted: Briefs and panties: Of cotton: Girls’. The duty rate will be 7.8 percent ad valorem.
The applicable subheading for the Styles 573 and 515 shorts will be 6104.62.2060, HTS, which provides for Women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear), knitted or crocheted: Trousers, bib and brace overalls, breeches and shorts: Shorts: girls’: Other. The duty rate will be 15.4 percent ad valorem.
The applicable subheading for Styles 470 and 570 tops will be 6109.10.0037, HTS, which provides for T-shirts, singlets, tank tops and similar garments, knitted or crocheted: of cotton . . . Women’s or girls’: Underwear. The duty rate will be 17.8 percent ad valorem.
The applicable subheading for style 531 will be 6109.10.0065, HTS, which provides for T-shirts, singlets, tank tops and similar garments, knitted or crocheted: of cotton . . . women's or girls': other: tank tops: girls. The rate of duty will be 17.8 percent ad valorem.
Style 574, style 470 and 570 panties and tops fall within textile category designation 352, the style 573 and 515 shorts fall within textile category designation 348, and style 531 falls within textile category designation 339. Based upon international textile trade agreements products of Turkey within textile category designations 352, 348, and 339 are subject to quota and the requirement of a visa.
The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
