RE: The tariff classification of travel bags and ashtrays from China.
Dear Ms. Feagans:
In your letter dated June 1st, 2001, you requested a ruling on behalf of Techtron Inc. on tariff classification.
The samples submitted with your request consist of ashtrays and travel bags. The ashtrays are made of glass. The travel bags, identified as “3 PC Travel Set,” consists of three travel bags of various sizes that will be imported in a condition for retail sale. Each bag, made of an exterior surface of sheeting of plastic, is secured by a zippered closure, and has carry handles.
You have asked whether the ashtrays are subject to antidumping duties or countervailing duties. A list of AD/CVD proceedings at the Department of Commerce (DOC) and their product coverage can be obtained from the DOC website at: http://ia.ita.doc.gov, or you may write to them at the U.S. Department of Commerce, International Trade Administration, Office of Antidumping Compliance, 14th Street and Constitution Avenue, N.W. Washington, DC 20230. Written decisions regarding the scope of AD/CVD orders are issued by the Import Administration in the Department of Commerce and are separate from tariff classification and origin rulings issued by Customs.
The applicable subheading for the travel bags will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports, and similar bags…other. The general rate of duty will be 20 percent ad valorem.
The applicable subheading for the ashtrays will be 7013.99.3000, Harmonized Tariff Schedule of the United States (HTS), which provides for glassware of a kind used for…office, indoor decoration or similar purposes…other glassware, other, other, smoker’s articles. The general rate of duty will be 9 percent ad valorem.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R.177).
