RE: The tariff classification of stainless steel gas vent system components from Canada.
Dear Ms. Swiatkowski:
In your letter dated August 17, 2001 on behalf of FLEX-L International, Inc., you requested a tariff classification ruling.
The products to be imported are “Star-34” components for a gas vent system. The components include stainless steel pipes, pipe fittings, joiner bands, firestops and wall thimbles. The stainless steel pipes measure either 3 inches or 4 inches in outside diameter and have a wall thickness of 0.005 inch. They have overlapping seams. The stainless steel pipe fittings include elbows, tees, slip connectors and increasers. The fittings are connected to the pipe by means of a joiner band. The firestops and wall thimbles are used to hold the pipe to the wall.
The applicable subheading for the stainless steel pipes will be 7306.90.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for other tubes, pipes and hollow profiles (for example, open seamed or welded, riveted or similarly closed), or iron or steel, other, of alloy steel. The general rate of duty will be 1.5 percent ad valorem.
The applicable subheading for the stainless steel elbows, tees, slip connectors and increasers will be 7307.29.0090, HTS, which provides for tube or pipe fittings (for example, couplings, elbows, sleeves), of iron or steel, other, of stainless steel, other, other. The general rate of duty will be 5 percent ad valorem.
The applicable subheading for the stainless steel joiner bands, firestops and wall thimbles will be 7326.90.8586, HTS, which provides for other articles of iron or steel, other, other, other, other, other. The general rate of duty will be 2.9 percent ad valorem.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
