Notice of the lifting of suspension occurred on the message date of these instructions. See paragraph 5 below.

1. Commerce received a scope ruling request from Alemite, LLC (Alemite). Commerce issued a final scope determination on 1/8/2020 that the hydraulic hand gun coupler (coupler) and the universal swivel assembly (swivel) imported by Alemite and described in detail below, are not within the scope of the antidumping and countervailing duty orders on forged steel fittings from the People's Republic of China (China) (A-570-067, C-570-068).

2. Commerce determined that Alemite's coupler made to its T2-231 proprietary standard and its swivel made to its T2-166 proprietary standard, are outside the scope of the orders because they are used to connect dispensing nozzles or grease fittings to hoses that convey noncorrosive fluid through a grease dispensing system, and therefore differ from subject merchandise, which is primarily used to distribute high pressure or corrosive liquids in the end markets of oil and gas.

The excluded products are made to Alemite's proprietary standards and are identified with the following SKU numbers:
- Coupler, SKU# 308730
- Swivel, SKU # 52752

To be excluded from the scope, these products must also not be manufactured to the specifications of ASME B16.11, MSS SP-79, MSS SP-83, MSS SP-97, ASTM A105, ASTM A350, and ASTM A182, and must have the appropriate standard or pressure markings and/or be accompanied by documentation demonstrating the compliance of the product to Military Specification MIL-L-4387D, Type VII, Class 3, Size 6 and/or Alemite's proprietary standards, "T2-231" or "T2-166."

3. For all entries of Alemite's coupler and swivel meeting the description of merchandise discussed in paragraph 2 above, imported by Alemite, that remain unliquidated and were entered, or withdrawn from warehouse, for consumption:

on or after 03/14/2018 for C-570-068 and

on or after 05/17/2018 for A-570-067,

CBP shall terminate suspension and liquidate such entries of products not within scope.

4. Refund any cash deposits relating to the two products not within the scope described above.

5. These instructions constitute notice of the lifting of suspension of liquidation of entries of the coupler and the swivel entered, or withdrawn from warehouse, for consumption on or after the dates covered in paragraph 3.

6. The assessment of antidumping and countervailing duties by CBP on shipments or entries of this merchandise is subject to the provisions of section 778 of the Tariff Act of 1930, as amended. Section 778 requires that CBP pay interest on overpayments or assess interest on underpayments of the required amounts deposited as estimated antidumping and countervailing duties. The interest provisions are not applicable to cash or bonds posted as estimated antidumping and countervailing duties before the date of publication of the antidumping and countervailing duty orders. Interest shall be calculated from the date payment of estimated antidumping and countervailing duties is required through the date of liquidation. The rate at which such interest is payable is the rate in effect under section 6621 of the Internal Revenue Code of 1954 for such period.

7. Unless instructed otherwise, for all other shipments of forged steel fittings from China not covered by paragraphs 2 and 3 above, you shall continue to collect cash deposits of estimated antidumping and countervailing duties for the merchandise at the current rates.
