On 06/01/2020 (85 FR 33117), Commerce published in the Federal Register its amended preliminary determination in the antidumping duty investigation of certain glass containers from the People's Republic of China.
See message 0157405, dated 06/05/2020.
In that amended preliminary determination, Commerce corrected the names of producers in certain exporter-producer combinations and included exporter-producer combinations that had been inadvertently omitted from the original preliminary determination.
Because the amended preliminary determination cash deposit rate for the exporter-producer combinations identified below is lower than the cash deposit rate that applied to these combinations based on the original preliminary determination, the cash deposit rate from the amended preliminary determination will be effective retroactively to 04/29/2020, the date of the original preliminary determination.
2.
Title 19 U.S.C. 1520(a)(4) authorizes refunds prior to liquidation whenever an importer of record declares or it is ascertained that excess duties, fees, charges, or exactions have been deposited or paid.
In accordance with 19 U.S.C. 1520(a)(4), CBP is authorized to grant a refund, if requested by the importer, of cash deposits for entries of certain glass containers from the People's Republic of China from the exporter-producer combinations listed in paragraph 4 below which were entered, or withdrawn from warehouse, for consumption during the period 04/29/2020 through 05/31/2020.
3.
The refund amount will be calculated by determining the difference between the amount of cash deposits paid as a result of the application of the preliminary determination cash deposit rate and the amount due as a result of the application of the amended preliminary determination cash deposit rate.
4.
Commerce did not assign the exact exporter-producer combinations listed below their own cash deposit rate in the preliminary determination.
Accordingly, entries from these exporter-producer combinations may have been made under the case number and cash deposit rate for the China-wide entity (A-570-114-000), see message 0128401, dated 05/07/2020.
