1.
The Department of Commerce published in
the Federal Register
on
April
15,
1992, notice
of
its antidumping duty
order
on
Aspheric Ophthalmoscopy Lenses (lenses) from Japan.
2.
The
products
covered
by
this investigation
are
aspheric
aphthalmoscopy lenses, whether
mounted
or unmounted, framed
or
unframed, of which one or both surfaces are aspherical in shape.
the
sujbect
merchandise
is
currently
classifiable
under
subheading 9010.50.00 of
the Harmonized Tariff
Schedule
(HTS).
although the
HTS number
is provided for convenience and Customs
purposes, our written description of the scope of this proceeding
is dispositive.

For further reporting purposes this
case
has
been assigned
investigation number A-588-819.
4. When
the International Trade Commission (ITC) finds threat of
material injury,
and
makes
a
negative "but
for" finding, the
"Special
Rule"
provision
of
section
736(b)(2)
applies.
Therefore, all unliquidated entries or warehouse withdrawals, for
consumption of lenses from Japan made on or after April 15, 1992,
the
date
of
which the
ITC
will publish its final affirmative
determination
of
threat
of
material
injury
in
the
Federal
Register,
will
be
liable
for
the
assessment
of antidumping
duties.
For exports of lenses from
Japan
by
Nikon Corporation
and
all other companies, the Customs Service shall terminate the
suspension of liquidation for
entries entered, or withdrawn from
warehouse, for consumption before April 15, 1992, and
to release
any bond
or other security, and refund any
cash deposit, posted
to
secure
the
payment
of
estimated antidumping
duties
with
respect to these entries.
5.
For export of lenses from Japan by Nikon Corporation and
all
other companies, the
Customs
Service
shall
assess antidumping
duties on
all entries of lenses from Japan, entered or withdrawn
from warehouse, for consumption on
or after April 15,
1992
and
shall require
a
cash deposit equal
to
the
margin percentages
listed below:
