RE: FINAL SCOPE RULING ON MMF SWEATERS FROM TAIWAN (A-583-808)
1.
ON AUGUST 28, 1991, THE DEPARTMENT OF COMMERCE ISSUED A FINAL
SCOPE RULING THAT CERTAIN FINE-KNIT MAN-MADE FIBER (MMF) SWEATERS
(MODELS S924J, S925J, AND S771J) THAT BERNARD CHAUS (CHAUS)
IMPORTS FROM TAIWAN ARE NOT WITHIN THE SCOPE OF THE ANTIDUMPING
DUTY ORDER ON SWEATERS WHOLLY OR IN CHIEF WEIGHT OF MAN-MADE
FIBER FROM TAIWAN.
2.
THESE SWEATERS WERE FOUND TO BE OUTSIDE THE SCOPE OF THE
ORDER BECAUSE THEY ARE SWEATERS HAVING MORE THAN NINE STITCHES
PER TWO LINEAR CENTIMETERS HORIZONTALLY (APPROXIMATELY 11 OR 12
STITCHES PER TWO CENTIMETERS) WHOSE BOTTOM RIB IS LINKED ON, AS
OPPOSED TO KNIT ON.
3.
EFFECTIVE IMMEDIATELY, TERMINATE SUSPENSION AND LIQUIDATE ALL
UNLIQUIDATED ENTRIES, REGARDLESS OF ENTRY DATE, OF THE
ABOVE-LISTED PRODUCT.
4.
REFUND ANY CASH DEPOSITS AND RELEASE ANY BONDS RELATING TO
THE ABOVE-LISTED PRODUCTS.
5.
IN ACCORDANCE WITH PREVIOUS INSTRUCTIONS, CONTINUE TO SUSPEND
LIQUIDATION OF ENTRIES OF MMF SWEATERS FROM TAIWAN.
6.
