1. On 03/01/2023, Commerce issued a final circumvention determination that certain welded carbon steel standard pipes and tubes completed in Oman and the United Arab Emirates using India-origin hot-rolled steel (inquiry merchandise) are not circumventing the antidumping duty order on certain welded carbon steel standard pipes and tubes from India (A-533-502). See 88 FR 12917. 2. Commerce determined that products covered by the determination are not circumventing the antidumping duty order on certain welded carbon steel standard pipes and tubes from India because the totality of circumstances did not support an affirmative circumvention determination. 3. This final circumvention determination is applicable on a country-wide basis, regardless of foreign producer, exporter, or importer. 4. Antidumping duty orders currently exist on welded carbon steel standard pipes and tubes from Oman (A-523-812) and from the United Arab Emirates (A-520-807). In the circumvention inquiry, Commerce considered whether certain welded carbon steel standard pipes and tubes completed in Oman and the United Arab Emirates using India-origin hot-rolled steel were circumventing the antidumping duty order on certain welded carbon steel standard pipes and tubes from India and, therefore, subject to the antidumping duty order on certain welded carbon steel standard pipes and tubes from India (A-533-502) rather than the antidumping duty orders on merchandise from Oman (A-523-812) or the United Arab Emirates (A-520-807). Based on Commerce's final circumvention determination, the products covered by this inquiry are not subject to the antidumping duty order on merchandise from India. Thus, inquiry merchandise that meets the description of merchandise covered by the scope of the antidumping duty orders on certain welded carbon steel standard pipes and tubes from Oman (A-523-812) or the United Arab Emirates (A-520-807) remains subject to those orders. CBP should examine entries of certain welded carbon steel standard pipes and tubes that entered under the antidumping duty order on India (A-533-502) and that were exported from Oman or the United Arab Emirates to determine the appropriate antidumping duty order for continued suspension of liquidation until liquidation instructions are issued. 5. Entries of certain welded carbon steel standard pipes and tubes from Oman (A-523-812) and the United Arab Emirates (A-520-807) should not be liquidated until specific liquidation instructions are issued. 6. For all other merchandise subject to the scope of the order on certain welded carbon steel standard pipes and tubes from India (A-533-502), continue to suspend liquidation at the rate(s) in effect on the date of entry until specific liquidation instructions are issued. 7. In accordance with 19 CFR 351.226(l)(5), this instruction does not affect or otherwise limit CBP's independent authority to take any additional action with respect to the suspension of liquidation or related measures. 8.
