ON JANUARY 13, 1994, IN RESPONSE TO A REQUEST BY PETITIONERS,
THE DEPARTMENT OF COMMERCE ISSUED A PRELIMINARY SCOPE RULING
THAT (1) PIPE CERTIFIED TO AMERICAN PETROLEUM INSTITUTE (API)
5L LINE PIPE SPECIFICATIONS (API 5L LINE PIPE OR LINE PIPE)
AND (2) PIPE CERTIFIED TO BOTH THE API 5L LINE PIPE
SPECIFICATIONS AND THE LESS STRINGENT AMERICAN STANDARD
TESTING AND MATERIALS (ASTM) A-53 STANDARD PIPE
SPECIFICATIONS (DUAL-CERTIFIED PIPE), WHEN ACTUALLY USED AS
CERTAIN CIRCULAR WELDED NON-ALLOY STEEL PIPE (STANDARD PIPE),
AND FALLING WITHIN THE PHYSICAL PARAMETERS OUTLINED IN THE
SCOPE OF THE ORDERS, ARE WITHIN THE SCOPE OF THE ANTIDUMPING
DUTY ORDERS ON STANDARD PIPE.
2.
CONTINUE TO SUSPEND LIQUIDATION OF ENTRIES OF CERTAIN
CIRCULAR WEDLED NON-ALLOY STEEL PIPE FROM THE FOUR SUBJECT
COUNTRIES.
3.
COMMERCE IS CURRENTLY PREPARING END-USE CERTIFICATES FOR
IMPLEMENTATION OF THE PRELIMINARY SCOPE DECISION.
THIS
INFORMATION WILL FOLLOW SHORTLY.
UNTIL THESE CERTIFICATES
ARE ISSUED BY COMMERCE, EFFECTIVE JANUARY 13, 1994, SUSPEND
LIQUIDATION FOR ENTRIES OF ALL DUAL-CERTIFIED PIPE AND API 5L
LINE PIPE AT A ZERO DEPOSIT RATE.
UPON ISSUANCE OF THE
CERTIFICATES, IMPORTERS MAY SUBMIT THE APPROPRIATE
CERTIFICATE AND IF APPROPRIATE RECEIVE LIQUIDATION OF THEIR
ENTRIES.
