1. On 08/13/2024, Commerce issued a final scope ruling that off-grid solar charging modules with part number GC4291F, GC4291FE, GC3291F, or GC3291FE made with Chinese solar cells that are imported by GameChange Solar Corp. are covered by the scope of the antidumping and countervailing duty orders on crystalline silicon photovoltaic cells, whether or not assembled into modules, from the People's Republic of China (Orders)(A-570-979, C-570-980). 2. Specifically, Commerce determined that off-grid solar charging modules with part number GC4291F, GC4291FE, GC3291F, or GC3291FE made with Chinese solar cells that are imported by GameChange Solar Corp. are covered by the scope of the Orders because the solar cells/solar panels in the charging modules do not differ physically from solar cells/solar panels covered by the scope of the Orders nor do they meet any of the exclusions in the scope of the Orders. 3. This final scope ruling is applicable only to off-grid solar charging modules with part number GC4291F, GC4291FE, GC3291F, or GC3291FE made with Chinese solar cells that are imported by GameChange Solar Corp. 4a. Continue to suspend liquidation of entries of off-grid solar charging modules with part number GC4291F, GC4291FE, GC3291F, or GC3291FE made with Chinese solar cells that are imported by GameChange Solar Corp. that are already subject to the suspension of liquidation under the antidumping and countervailing duty orders on crystalline silicon photovoltaic cells, whether or not assembled into modules, from the People's Republic of China at the cash deposit rates in effect on the date of entry in accordance with message 3298403, dated 10/25/2023. 4b. For all entries of off-grid solar charging modules with part number GC4291F, GC4291FE, GC3291F, or GC3291FE made with Chinese solar cells that are imported by GameChange Solar Corp. that are not already subject to the suspension of liquidation, CBP should suspend liquidation of: (i) shipments entered, or withdrawn from warehouse, for consumption on or after 10/17/2023 (date of initiation of the scope inquiry), and (ii) shipments entered, or withdrawn from warehouse, for consumption prior to the date of initiation of the scope inquiry but no earlier than November 4, 2021 (effective date of the suspension rules in the new scope regulations). CBP shall require, for such entries, a cash deposit at the applicable rates in effect on the date of entry. 5. Entries of products covered by paragraph 4 should not be liquidated until specific liquidation instructions are issued. 6. In accordance with 19 CFR 351.225(l)(5), this instruction does not affect or otherwise limit CBP's independent authority to take any additional action with respect to the suspension of liquidation or related measures. 7.
