1. On 6/6/2016, 81 FR 35326, the Department of Commerce (“Commerce”) published in the Federal Register its final determination of countervailing duty investigation of certain corrosion-resistant steel products (“corrosion-resistant steel”) from Italy.
In this final determination Commerce also continued to find that critical circumstances exist with respect to certain shipments of corrosion-resistant steel from Italy entered, or withdrawn from warehouse, for consumption between 8/8/2015 and 11/6/2015.

However, on 7/20/2016, the International Trade Commission (“ITC”) determined that critical circumstances do not exist with respect to subject imports from Italy.
Because the ITC determined that critical circumstances do not exist, the retroactive suspension of liquidation, determined in 81 FR 35326 and ordered in message 5313303 dated 11/9/2015, is terminated.
3. Accordingly, CBP is directed to terminate the suspension of liquidation for all entries of subject merchandise suspended during the period 8/8/2015 through 11/5/2015, and liquidate without regard to antidumping duties (i.e., refund all cash deposits or other security).

For imports of corrosion-resistant steel from Italy, CBP shall continue to suspend liquidation of such shipments entered, or withdrawn from warehouse, for consumption on or after 11/6/2015, at the rates in effect at the time of entry.
5. Interest provisions of section 778 of the Tariff Act of 1930, as amended, do not apply.
