1. Commerce received a scope ruling request from ProPulse, A Scheiffer Company (ProPulse). Commerce issued a final scope determination on 10/15/2019 that ProPulse's hydraulic hose fittings made to either the ISO 12151-2 or 12151-6 standard which ProPulse imports are not within the scope of the antidumping and countervailing duty orders on forged steel fittings from China, Italy, and Taiwan (A-570-067, A-475-839, A-583-863, C-570-068).
2. Commerce determined that ProPulse's hydraulic hose fittings made to either the ISO 12151-2 or 12151-6 standard, to the extent such fittings are not also manufactured to the specifications of ASME B16.11, MSS SP-79, MSS SP-83, MSS SP-97, ASTM A105, ASTM A350, and ASTM A182, are outside the scope of the orders because they are used to connect hoses and tubes that convey noncorrosive fluid through machines and therefore differ from the subject merchandise, which is primarily used to distribute high pressure or corrosive liquids in the end markets of oil and gas.
To be excluded from the scope, products must have the appropriate standard or pressure markings and/or be accompanied by documentation showing product compliance to the applicable standard or pressure, e.g., 'ISO 12151-2' mark and/or a mill certification report.
3. For all unliquidated entries of hydraulic hose fittings meeting the description of merchandise discussed in paragraph 2 above, imported by ProPulse, that were entered, or withdrawn from warehouse, for consumption:
on or after 03/14/2018 for C-570-068 and
on or after 05/17/2018 for A-570-067, A-475-839, and A-583-863,
CBP shall terminate suspension and liquidate such entries without regard to duties (i.e., refund all cash deposits).
4. These instructions constitute notice of the lifting of suspension of liquidation of entries of merchandise covered by paragraphs 2 and 3.
5. The assessment of antidumping and countervailing duties by CBP on shipments or entries of this merchandise is subject to the provisions of section 778 of the Tariff Act of 1930, as amended. Section 778 requires that CBP pay interest on overpayments or assess interest on underpayments of the required amounts deposited as estimated antidumping and countervailing duties. Interest shall be calculated from the date payment of estimated antidumping and countervailing duties is required through the date of liquidation. The rate at which such interest is payable is the rate in effect under section 6621 of the Internal Revenue Code of 1954 for such period. The interest provisions are not applicable to cash or bonds posted as estimated antidumping and countervailing duties before the date of publication of the antidumping and countervailing duty orders.
The publication date of the orders are as follows:
11/26/2018 for C-570-068 (83 FR 60396), A-570-067 (83 FR 60397), and A-475-839 (83 FR 60397), and 09/24/2018 for A-583-863 (83 FR 48280).
6. Unless instructed otherwise, for all other shipments of forged steel fittings from China, Italy, and Taiwan not covered by paragraphs 2 and 3 above, you shall continue to collect cash deposits of estimated antidumping and countervailing duties for the merchandise at the current rates.
