PLEASE PASS TO CUSTOMHOUSE BROKERS, IMPORTERS AND OTHER INTERESTED
PARTIES
BACKGROUND: PUBLIC LAW 103-182, DATED DECEMBER 8, 1993 CALLED FOR THE
ELIMINATION OF THE MERCHANDISE PROCESSING FEE FOR GOODS OF MEXICAN
ORIGIN THAT QUALIFY FOR NAFTA PREFERENTIAL TARIFF TREATMENT EFFECTIVE,
JUNE 30, 1999.
ACTION: EFFECTIVE JUNE 30, 1999, QUALIFYING PRODUCTS OF MEXICAN ORIGIN,
ENTERED, OR WITHDRAWN FROM WAREHOUSE FOR CONSUMPTION, ARE EXEMPTED FROM
THE CUSTOMS USER FEES AS IDENTIFIED IN 19 U.S.C. 58C(A)(9) AND (10).
THESE FEES ARE COMMONLY REFERRED TO AS THE MERCHANDISE PROCESSING FEES
(MPF'S).
THIS EXEMPTION APPLIES TO ALL MEXICAN PRODUCTS QUALIFYING AS NAFTA
ORIGINATING GOODS IDENTIFIED AND ENTERED WITH THE FOLLOWING SPECIAL
PROGRAM INDICATORS (SPIS):
C# - CIVIL AIRCRAFT; K# - PHARMACEUTICAL PRODUCTS; L# - INTERMEDIATE
CHEMICALS FOR DYES; MX - NAFTA ORIGINATING GOODS.
ENTRIES WILL BE REJECTED IF THE MPF IS SHOWN ON THE LINE.
ACS HAS ASSURED US THAT THE NECESSARY PROGRAMING CHANGES WILL BE IN
PLACE ON TIME. IF, FOR ANY REASON, THIS CAN NOT BE ACCOMPLISHED,
PROCEDURAL INSTRUCTIONS WILL BE ISSUED.
